TERM & CONDITIONS

    • This project is purely conducted by Prime Lands (Private) Limited (hereinafter referred to as the “Company”) a Company duly incorporated in Democratic Socialist Republic of Sri Lanka under the Companies Act No:07 of 2007 bearing registration No: P V 7088 and having its registered office at No:75, D.S Senanayake Mawatha, Borella, Colombo-08 in the said Republic of Sri Lanka
    • This project shall only be conducted through online and the deal prices mentioned hereunder will only available online.
    • Only the Sri Lankan Citizens and/or the registered companies (morethan 50% of shares should be owned by the Sri Lankan Citizens) in Sri Lanka (hereinafter referred to as the “Customer”) shall be eligible to purchase the lands/slots mentioned hereunder and the foreigners/non-citizens shall not be eligible for this.
    • The Customer shall be responsible to comply with all the statutory compliances as required from time to time under the applicable laws prevailing in the Democratic Socialist Republic of Sri Lanka.
    • The initial online payment of Rs.25,000/- shall be made by the customer to the Company as a “Booking Fee” when doing the reservation for the intended land/slot.
    • The Customer shall select the intended land/slot displayed online and/or visit the intended land/slot before making the Booking Fee of Rs.25,000/-
    • The Customer shall be required to submit the detailed Application Form by providing the full name (As per his/her National Identity Card) and the National Identity Card Number and the permanent residential address when doing the Booking Fee of Rs.25,000/-.
    • If the Customer is a duly registered company in Sri Lanka, then the Customer shall be required to provide the details of the Company name, Registration number, Registered address, details of Form 15, Form 20, Company Articles and any other document as requested by the Company.
    • The Customer shall pay the initial reservation payment and shall choose prime payment options and shall sign/enter into the necessary legal documents as requested by the Company within a period of 07 days from the date of making the Booking Fee of Rs.25,000/- to the Company for the respective reserved land/slot.
    • If the Customer fails to pay the initial reservation payment within seven days as specified above clause the booking of the said land will be cancelled automatically and booking fee of Rs.25,000/- will be forfeited and the customer has no rights to claim the said booking fee or any claims thereafter.
    • The Customer will be entitled to a discount for the respective reserved land/slot as displayed if any online when the Customer makes the full payment to the Company.
    • The initial online payment of Rs.25,000/- (Booking Fee) shall not be deducted from the capital Sale Value and shall be forfeited by the Company as a non-refundable deposit.
    • The initial online payment of Rs.25,000/- shall be accepted through the internet payment gateway only.
    • The online payment of Rs.25,000/- herein mentioned is subject to the rules and regulations of respective Bank of Sri Lanka as well as the rules and regulations framed of the VISA/MasterCard or any other card organization applicable and prevailing from time to time.
    • In the event of the Customer failing, neglecting or refusing to comply with the terms and conditions of this transaction, the Company shall have the right to cancel the reservation and forfeit Rs.25,000/- with the Company.
    • The said payment of Rs.25,000/- shall be subject to the risks involved in any Electronic Payment Transactions including due to any technical failure in the payment gateway operations and the Company shall not be liable/responsible for any failure of any payment transactions or for any amounts debited from the Customer account but not credited to the account of the Company due to any technical error in settlement or otherwise and the Customer shall not have any claims against the Company for such transactions. Wherever possible, the Company will inform the Customer about such failed transaction and refund, if any, due to the Customer shall be processed via payment gateway.
    • The said payment is merely towards expressing an interest in a particular land/slot and by virtue of said payment no right, title, interest or claim of any nature is created in such land/slot.
    • Upon said payment being credited to the account of the Company, an e-receipt number will be generated and emailed to the Customer which shall be mandatorily be required for processing further the application of the Customer. The Customers are required to print or save the receipt for his transaction/records and submit the same to the Company as may be requested to do so.
    • In case it is learnt that the Client has misrepresented any fact or information such applications shall be summarily terminated and said payment shall be transferred.


PRIVACY POLICY

    • The information which is provided by the Customer herein may be used by the Company and its affiliates:-
      1. To send important notices/communications regarding the status of their Expression of Interest Form etc. and the relevant policies, terms, conditions, etc.;
      2. To keep the Customer posted on their project launches, announcements, project updates and upcoming events and to improve their services, content, advertising. If the Customer does not want to be on their mailing list, the Customer can opt out anytime by updating his/her reference by sending an ‘do not send promotional announcements’ email to ……………………………
      3. For internal purposes such as auditing, data analysis, and research to improve its products, services and customer communications.
      4. The Company shall take reasonable security practices to protect the privacy of the information provided by the Customer. Except as mentioned herein, the Company shall not disclose such information to any third party. However nothing contained hereinabove shall apply to any disclosure of confidential Information if:-
        1. Such disclosure is required by law or requested by any statutory or regulatory or judicial/quasi-judicial authority or recognized self-regulating organization or other recognized investment exchange having jurisdiction over the Parties; or
        2. Such disclosure is required in connection with any litigation; or
        3. Such information has otherwise entered the public domain.
      5. The terms and conditions contained herein and in the Application Form shall be construed in accordance with the laws of Sri Lanka and any disputes/issues arising out of this transaction shall be subject to the exclusive jurisdiction of Courts of Sri Lanka.
